Ink and Brush is a California-based business offering original art and related physical products for sale through our Website. We reserve the right to change prices, product availability, and these Terms at any time.

To the maximum extent permitted by law, Ink and Brush shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of, or inability to use, our Website or products.

In the event a product is listed at an incorrect price due to a typographical or technical error, we reserve the right to cancel the order. If your payment method has already been charged, we will issue a full refund.

Shipping

Ink and Brush will make reasonable efforts to ship Products within the timeframe stated at checkout. Shipping times are estimates only and are not guaranteed. Risk of loss and title for Products pass to you upon our delivery to the shipping carrier.

Returns and Refunds

We want you to be happy with your purchase. If you are not satisfied with a Product, please contact us within 7 days of delivery at info@inkandbrush.art to discuss a return, exchange, or refund. Because many of our pieces are original or limited-availability artwork, items must be returned in their original condition, and certain custom or commissioned pieces may not be eligible for return.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles, except where superseded by the arbitration provisions below.

Agreement to Arbitrate

Except for disputes relating to the enforcement or validity of intellectual property rights, or claims that qualify for small claims court, you and Ink and Brush agree that any dispute arising out of or relating to this Agreement or the Services will be resolved through binding arbitration rather than in court, except that either party may seek injunctive relief in court to protect its rights pending arbitration.

Notice of Dispute

Before initiating arbitration, you or Ink and Brush must send a written Notice of Dispute describing the dispute and the relief sought. Notices to Ink and Brush must be sent to info@inkandbrush.art. We will send any Notice of Dispute to you using the contact information on your account. The parties will attempt to resolve the dispute informally for 60 days before either party commences arbitration.

Binding Arbitration

If the dispute is not resolved informally, it shall be settled by binding arbitration administered under the commercial arbitration rules of the American Arbitration Association. You and Ink and Brush each waive the right to a jury trial and to participate in a class action. Either party may seek interim injunctive relief from a court of competent jurisdiction pending the outcome of arbitration. The prevailing party shall be entitled to recover reasonable attorneys' fees and costs.

Time Limit on Claims

Any cause of action arising out of or related to the Services must be commenced within one (1) year after the cause of action accrues, or it will be permanently barred.

Severability and Waiver

If any provision of this Agreement is found unenforceable, the remaining provisions will remain in full force and effect. No waiver of any term shall be deemed a continuing waiver of that term or any other term.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide at least 30 days' notice before the new terms take effect, unless otherwise required by law. Continued use of the Website after changes take effect constitutes acceptance of the revised Terms.

Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Ink and Brush regarding your use of the Website and supersede any prior agreements.

Disclaimer

Ink and Brush is not responsible for typographical errors or inaccuracies on the Website and reserves the right to correct them at any time without notice. The Website and its contents are provided without warranties of any kind, to the fullest extent permitted by law.
